Terms of Service

1. Acceptance of Terms

By accessing or using PlanXpress ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

These terms apply to all users of the Service, including administrators, employees, and any other users granted access through your organization's subscription.

2. Description of Service

PlanXpress provides workforce management solutions for contact centers, including:

  • AI-powered call volume forecasting
  • Erlang C and Erlang A staffing calculations
  • Schedule generation and optimization
  • Activity logging and reporting
  • Business unit management

3. Subscription and Billing

Access to the Service requires a paid subscription. By subscribing, you agree to:

  • Pay all fees associated with your selected subscription plan
  • Provide accurate billing information
  • Keep your payment information current
  • Accept automatic renewal of your subscription unless canceled

Subscription fees are billed monthly in advance. Refunds are provided at our sole discretion and in accordance with applicable law.

4. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring all users added to your organization comply with these terms

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

You retain ownership of all data you upload to the Service. You grant us a limited license to process this data solely for the purpose of providing the Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share login credentials with unauthorized users
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Reverse engineer or attempt to extract source code
  • Use the Service to process data in violation of applicable laws

7. Intellectual Property

The Service, including all software, algorithms, designs, and documentation, is owned by 110 Global and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive license to use the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may:

  • Perform scheduled maintenance with reasonable notice
  • Modify or discontinue features with notice
  • Temporarily suspend service for security or legal reasons

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 110 GLOBAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from these terms or your use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Termination

You may cancel your subscription at any time. We may terminate or suspend your access if you violate these terms or fail to pay fees when due.

Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new terms.
